California's Drug Manufacturing Laws
In California, drug manufacturing is covered under the Section 11379.6 of the Health & Safety Code. Under this section, every person who manufactures, compounds, converts, produces, derives, processes, or prepares a chemical extraction directly or indirectly, or independently by means of chemical synthesis, any controlled substance specified in Sections 11054 – 11058, shall be punished to three, five, or seven years in prison and by a fine not to exceed $50,000.
Under Section 11379.7, any person who is convicted of violating 11379.6 or 11383 involving methamphetamine or phencyclidine, and the offense was committed or attempted in a structure in the presence of a child under 16, shall be sentenced to an additional two years in the state prison.
Legal Defenses to Drug Manufacturing Charges
Just because you were arrested, it doesn't mean that you have to be convicted. There are a number of legal defenses, any one of which may apply to your case. Your actions may have been merely preparatory, or your search and seizure rights may have been violated, or you could have been at the wrong place at the wrong time. Or, you may be a victim of false accusations or mistaken identity.
As an experienced drug crime lawyer, Attorney Castillo will explore every possible angle and look for any holes in the prosecution's case that may exonerate you. In a free consultation, we will carefully examine your case and develop a defense strategy to protect your constitutional rights, your freedom and your reputation.
