Understanding State vs. Federal Drug Laws
Under Section 11352 of the Health & Safety Code, every person who transports, imports, sells, furnishes, administers, or gives away, or offers to transport, import into California, sell, furnish, administer, or give away any controlled substance specified under Section 11054, or any controlled substance classified as a Schedule III, IV, or V, which is a narcotic drug, without a valid prescription, shall be punished to three, four, or five years in prison.
Depending upon the facts of the case, a transportation charge can be prosecuted as a federal crime. This means that you can be prosecuted in federal court.
- According to the United States Drug Enforcement Administration (DEA), you could face the following penalties for a federal drug trafficking charge:
- Cocaine (500 – 4,999 grams mixture): First offense, between 5 and 40 years in prison, and fine not to exceed $5 million if an individual.
- Heroin (100-999 grams mixture): First offense, 5 to 40 years in prison, and maximum $5 million dollar fine.
- LSD (1-9 grams mixture): First offense, 5 to 40 years in prison, and maximum $5 million dollar fine.
- Other Schedule I & II substances not specified: First offense, not more than 20 years in prison and a maximum $1 million dollar fine for an individual.
