California DUI Laws and Penalties
California's DUI laws are covered under VC § 23152-23229.1, which make it illegal for any person who is under the influence of an alcoholic beverage to operate a motor vehicle. In California, you cannot drive with a blood alcohol concentration (BAC) of .08% or higher. For commercial drivers, it is against the law to drive with a BAC of .04%, and for drivers under the age of 21, they cannot drive with any detectable amount of alcohol in their system (.01%) under California's Zero Tolerance law.
Penalties for a First Time DUI (drivers over 21):
- 4 month driver's license suspension
- Up to 6 months in jail
- Up to $1,000 in fines
Penalties for a Second DUI Offense Within 10 Years:
- 1 year driver's license suspension
- 90 days to 1 year in jail
- Up to $1,000 in fines
Penalties for a Third DUI Offense Within 10 Years:
- 1 year driver's license suspension
- 120 days to 1 year in jail
- Up to $1,000 in fines
Optional DMV Ignition Interlock Device (IID)
If you have been convicted of a second or subsequent DUI, you may be eligible for a restricted driver's license if you install an ignition interlock device (IID).
As of July 1, 2010, legislative changes have allowed for shorter suspension/revocation periods for second or third DUI offenders who install an IID and receive an IID restricted driver's license after the mandatory suspension/revocation period. However, the offense must have occurred after July 1, 2010 and cannot involve drugs.
Second DUI offenders whose violation involved alcohol may reinstate after a 90-day suspension when they provide proof of enrollment in a DUI program. Third DUI offenders whose violation involved alcohol may reinstate after a 6-month revocation with proof of enrollment in an 18 or 30 month DUI program.
